3.1. Visiting our website
When you visit our website at www.effektengesellschaft.de, the browser used on your device automatically sends information to our website server and temporarily stores it in a log file. We have no influence over this. The following information is collected without your intervention and stored until it is automatically deleted:
• the IP address of the requesting Internet-enabled device,
• the date and time of access,
• the name and URL of the file accessed,
• the website from which access was made (referrer URL),
• the browser you are using and, if applicable, the operating system of your Internet-
enabled computer and the name of your access provider.
The legal basis for processing the IP address is Article 6(1)(f) GDPR. Our legitimate interest arises from the purposes of data collection listed below. At this point, we would like to point out that we cannot draw any direct conclusions about your identity from the data collected, nor do we do so.
We use the IP address of your device and the other data listed above for the following purposes:
• To ensure a smooth connection setup,
• To ensure convenient use of our website,
• To evaluate system security and stability.
The data is stored for a period of two weeks and then automatically deleted. We also use cookies on our website. The exact procedures involved and how your data is used for this purpose are explained in more detail in section 3.3 below.
3.2. Conclusion, execution, or termination of a contract
3.2.1. Data processing upon conclusion of a contract
As a rule, it is possible to use our website without providing personal data. Insofar as personal data (e.g., name, address, or email addresses) is collected on our website, this is always done on a voluntary basis as far as possible.
If, in exceptional cases, you contact us with a specific contract-related request, we will process the data necessary for the conclusion, execution, or termination of a contract with you in this context. This may include:
• First name, last name
• Address
• Email address
• Account details
• Date of birth
• Phone number
The legal basis for this is Article 6(1)(b) GDPR, i.e. you provide us with the data on the basis of the contractual relationship between you and us. We store the data collected for the purpose of contract processing until the expiry of the statutory or possible contractual warranty rights. After this period has expired, we retain the information required by commercial and tax law relating to the contractual relationship for the periods specified by law. During this period (usually ten years from the conclusion of the contract), the data will only be processed again in the event of an audit by the tax authorities.
3.2.2. Your identity
Where necessary, we will verify your identity with the help of information from service providers. The legal basis for this is Article 6(1)(b) and (f) of the GDPR. The justification for this arises from the protection of your identity and the prevention of fraud attempts at our expense. The circumstances and results of our request will be stored in your customer account or guest account for the duration of the contractual relationship.
3.2.3. Contact option via the website
Due to legal requirements, the website of Berliner Effektengesellschaft AG contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address for electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted voluntarily by a data subject to the controller is stored for the purposes of processing or contacting the data subject. This personal data is not passed on to third parties.
3.3. Online presence and website optimization
3.3.1. Cookies – General information
We use cookies on our website. If these cookies contain personal data, their use is based on Article 6(1)(f) GDPR. Our interest in optimizing our website is considered legitimate within the meaning of the aforementioned provision. Cookies are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do not cause any damage to your device and do not contain viruses, Trojans, or other malware. Information related to the specific device used is stored in the cookie. However, this does not mean that we immediately become aware of your identity. The use of cookies serves, on the one hand, to make the use of our website more pleasant for you. We use so-called session cookies to recognize that you have already visited individual pages of our website or that you have already logged into your customer account. These are automatically deleted after you leave our site. In addition, we also use temporary cookies for the purpose of user-friendliness, which are stored on your device for a specific period of time. If you visit our site again to use our services, it will automatically recognize that you have already been with us and what entries and settings you have made so that you do not have to enter them again.
On the other hand, we use cookies to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you, as well as to display information tailored specifically to you. These cookies enable us to automatically recognize that you have already visited our site when you visit it again. These cookies are automatically deleted after a defined period of time. Most browsers automatically accept cookies. However, you can configure your browser so that no cookies are stored on your computer or so that a message always appears before a new cookie is created. However, completely deactivating cookies may mean that you cannot use all the functions of our website. The storage period of cookies depends on their purpose and is not the same for all cookies.
3.3.2. Objection/opt-out option
In addition to the deactivation methods described above, you can also generally prevent the technologies described from being used by adjusting your cookie settings in your browser.
3.4. Other processing activities
3.4.1. Applicants/employees
If you apply to us by email, we ask applicants for personal data such as their name, address, qualifications, and professional experience. As soon as a contractual relationship between you and us arises within the framework of temporary employment, we require further confidential information, including your tax identification number and tax class. We only collect the personal data that is absolutely necessary for our services.
Once you have provided us with personal information, you can always view or revoke it upon request, or ask us to correct and, if necessary, delete the data.
We only use your address, telephone number, and email address to contact you regarding our services. Berliner Effektengesellschaft AG may use the personal data collected for statistical purposes. Data will only be passed on to third parties if all confidential and personal data (name, address, etc.) has been removed. We do not sell or rent personal data to third parties. Your personal data is stored on specially protected computers and servers. The reading and further processing of your data is subject to strict internal regulations and is carried out exclusively for the purpose for which you have provided us with this data.
Under no circumstances should the information on the website of Effektengesellschaft AG at the domain www.effektengesellschaft.de be construed as a concrete offer for an employment contract or a recommendation for a specific position.
4. Recipients outside the EU
We do not disclose your data to recipients based outside the European Union or the European Economic Area.
5. Your rights
5.1. Overview
In addition to the right to revoke your consent given to us, you have the following additional rights if the respective legal requirements are met:
• Right to information about your personal data stored by us in accordance with Art. 15 GDPR; in particular, you can obtain
information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has
been or will be disclosed, the planned storage period, the origin of your data if it was not collected directly from you,
• Right to rectification of inaccurate data or completion of accurate data in accordance with Art. 16 GDPR,
• Right to erasure of your data stored by us in accordance with Art. 17 GDPR, provided that no statutory or contractual retention
periods or other legal obligations or rights to further storage must be observed,
• Right to restriction of processing of your data pursuant to Art. 18 GDPR, insofar as the accuracy of the data is disputed by you,
the processing is unlawful, but you refuse to have it deleted; the controller no longer needs the data, but you need it to assert,
exercise, or defend legal claims, or you have objected to the processing pursuant to Art. 21 GDPR,
• Right to data portability pursuant to Art. 20 GDPR, i.e. the right to receive selected data stored by us about you in a common,
machine-readable format, or to request that it be transferred to another controller,
• Right to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place
of residence or workplace or our company headquarters – in this case, the Berlin Commissioner for Data Protection and
Freedom of Information.
5.2. Right to object
Under the conditions of Art. 21 (1) GDPR, data processing may be objected to for reasons arising from the particular situation of the data subject.
The above general right to object applies to all processing purposes described in this privacy policy that are processed on the basis of Article 6(1)(f) GDPR. Unlike a specific right to object to data processing for advertising purposes, we are only obliged to implement such a general objection under the GDPR if you provide us with reasons of overriding importance (e.g., a possible danger to life or health). In addition, you have the option of contacting the supervisory authority responsible for Berliner Effektengesellschaft AG, the Berlin Commissioner for Data Protection and Freedom of Information.
6. Duration of storage of personal data
The duration of storage of personal data is determined by the respective statutory retention period (e.g., commercial and tax law retention periods). This period is usually 3 years (e.g., in the case of the regular limitation period for contractual claims) or 10 years (e.g., in the case of tax law retention periods). After expiry of the period, the corresponding data is routinely deleted, provided that it is no longer required for the fulfilment or initiation of a contract and/or we no longer have a legitimate interest in its further storage.
7. Data security
All data you submit personally, including your payment details, is transmitted using the standard SSL (Secure Socket Layer) security protocol. SSL is a secure and proven standard that is also used in online banking, for example. You can recognize a secure SSL connection by the s appended to https (https://www.effektengesellschaft.de/) in the address bar of your browser or by the lock symbol at the bottom of your browser.
